Context:

The Parliament passed the Bharatiya Vayuyan Vidheyak Bill 2024 to provide relief to aviation personnel in their licensing processes.

Highlights of the Bill

The Bharatiya Vayuyan Vidheyak 2024 bill aims to replace the Aircraft Act 1934 to regulate the civil aviation sector in India.

The bill retains the provisions of the Aircraft Act, 1934, and sets up three statutory authorities:

(i) Directorate General of Civil Aviation (DGCA) for performing regulatory functions and overseeing safety.

(ii) Bureau of Civil Aviation Security (BCAS) for overseeing security

(iii) Aircraft Accidents Investigation Bureau for investigation of aircraft accidents. 

The Union government may issue directions to these authorities and also review their orders in the public interest.  

The bill empowers the central government to make rules on:

Regulation of aircraft-related activities, such as licensing, certification, and inspection.

Regulation of air transport services.

Implementation of the International Civil Aviation Convention of 1944.

Regulation of radio telephone operator certificates and licenses under the International Telecommunication Convention.

Appellate mechanism  

The Bill retains the provisions of the Aircraft Act of 1934, which deal with the imposition of penalties for rule violations and the appointment of an officer to adjudicate penalties. The new provisions include:

  • Any appeals against decisions made by the First Appellate Officer will be heard by a Second Appellate Officer, who must be of higher rank than the First Appellate Officer.
  • The central government will hear appeals against orders issued by the DGCA or BCAS. No further appeals will be allowed against the central government's orders.
